Ted Strickland wants to put a 36 percent annual interest rate cap on loans made by payday lending stores. Chris Widener, R-Springfield, chairman of the House committee considering payday lending restrictions, said Friday, April 25, that he is taking a different approach. Strickland announced his position in a Friday letter to the Ohio Coalition for Responsible Lending, a group backing payday lending restrictions. Dever said that the rate cap backed by Strickland would put payday lenders out of business and “put in jeopardy 6,000 jobs in the state of Ohio. Strickland’s letter came a day after Xenia City Council voted to halt for up to a year the issuance of new zoning permits for cash advance or payday lending stories while city officials study how to strengthen regulations. read more

The Arkansas Supreme Court affirmed a circuit judge’s 2007 ruling ordering Dennis Bailey to pay the fines to the Arkansas State Board of Collection Agencies, which found he operated 14 payday lending outlets without a license. Bailey argued that the court should have remanded the case to the state board because the panel’s decision to fine him was not based on sworn testimony. In 2005, the board ordered Bailey to shut down his check-cashing operations because he did not have a license, but investigators learned over the next few months that he was still issuing payday loans. The others were Fast Cash Check Cashers in Camden, Cash Advance in Hot Springs, Cash Advance in Cabot and Central Arkansas Check Cashing in Newport. The $50 charge on the $350 loan for 14 days equates to 371 percent interest, well above Arkansas’ usury limit of 17 percent. Attorney General Dustin McDaniel has ordered payday lending outlets in Arkansas to shut down and stop collecting debts, or face lawsuits accusing them of charging high interest rates that violate the state constitution. read more

A report issued by nonprofit groups, Policy Matters Ohio and the Housing Research and Advocacy Center , put the number of payday lenders in the state at 1,638 in 2007, up 5 percent from the year before. Payday lenders make short-term loans of up to $800 at interest rates critics say are too high and can trap borrowers into a cycle of taking multiple loans in an effort to repay them. Opponents of the shops say the 15 percent interest rates on two-week loans amounts to an annualized 391 percent, and they are pushing Ohio lawmakers to lower rates and ease other terms of the loans. Payday lenders argue that making terms unattractive to lenders would force some to cease operations and leave borrowers that have no access to bank accounts struggling for cash. The report ends by recommending the state follow earlier federal protections for military families by capping annual percentage rate maximums for the industry at 36 percent, a measure also proposed in the Ohio House of Representatives through House Bill 333. read more

Charles Schumer warned New Yorkers yesterday to avoid payday loan providers offering to give a cash advance on the $600 stimulus checks taxpayers will receive in June. Chuck Grassley (R- Iowa ) will send a letter today to payday loan providers, warning them to abide by state laws that cap interest rates. State law restricts loans with interest rates higher than 25 percent, though such lenders can legally solicit New York State residents if they operate from out of state by telephone. The stimulus package that passed Congress last week will send a $600 rebate check plus $300 per child to anyone who paid taxes and earned up to $75,000 in 2007 or families that made up to $150,000. read more
