The Oregonian newspaper reports Advance is the latest of several payday loan outfits to close their doors since the state imposed a 36% annual interest rate cap on the short-term, high-rate consumer loans. They allow payday and car title lenders to charge a $10 origination fee per $100 loaned, though no more than $30 for a loan of any amount. Loans must be for at least 31 days and can carry an annual interest rate of 36%. Fees included, lenders can charge the equivalent of an annual interest rate of about 154% for a 31-day loan. read more

COLUMBUS (AP) - More than 300,000 Ohioans are trapped in a cycle of debt to payday lenders and are paying more than $318 million in payday loan fees each year, said a report released Wednesday. Studies have shown the average payday borrower uses more than one payday lending company annually, making the average number of loans likely higher than the 7. The Ohio Financial Services Association, which represents payday lenders, contested the report’s data because it estimated Ohio lending using information from four publicly traded payday companies and statistics from other states. If customers cannot pay off the amount of a loan plus an associated fee within two weeks, they often reborrow from the same payday lender or go to a different payday company to take out a loan to pay off the first loan. read more

Virginia legislators allow payday lenders to charge annual interest rates of almost 400 percent, but they can’t threaten criminal prosecution. Either Gail or Donald would get another loan every month that year at several payday stores, taking out 12 total to pay the other loans off. Donald told three lenders that he and his wife couldn’t pay back their last loans. That same day, Donald sent a letter to the Smithfield Checksmart, explaining that he didn’t have to pay anymore because of the Social Security exemption. read more

WASHINGTON (AP) — The Community Financial Services Association, which represents providers of short-term cash advances, spent $160,000 to lobby the federal government in the first half of 2007, according to a disclosure form. The Washington-based trade group lobbied Congress on regulations for the payday loan industry, which has been criticized for charging high interest rates to low-income consumers, according to the disclosure form posted online Aug. In addition to lawmakers, the trade group lobbied the Defense and Treasury departments, the Federal Deposit Insurance Corp. Congress last year passed a law limiting the amount of interest that members of the military and their dependents can pay on consumer loans to an annual rate of 36 percent. Consumer groups have been critical of the Defense Department’s implementation of the law, saying the Pentagon interpreted the cap to exclude many kinds of loans. Under a federal law enacted in 1995, lobbyists are required to disclose activities that could influence members of the executive and legislative branches. read more

STAUNTON - A measure condemning certain payday loan practices earned a resounding endorsement from the Staunton City Council on Thursday, a move believed to be unprecedented in Virginia. Hoping to see other communities follow suit, Staunton’s councilors gave unanimous approval to a resolution that asked the General Assembly to end certain “exploitative” policies by forcing payday lenders to cap their annual interest rates at 36 percent. That’s the standard ceiling imposed on most small loans in Virginia, but payday lenders - who issue short-term cash advances holding a post-dated check or access to a borrower’s bank account as collateral - are currently held to a different code. On a two-week repayment schedule - the length of time allotted for many payday loans - that’s the equivalent of an annual interest rate of 391 percent. When the floor was opened to public comment, Advance America lobbyist Dan Drummond urged the councilors to think of the impact an interest cap would have, pointing to nine payday loan employees in the audience. Eleven bills on the subject were introduced during the 2007 session and plans - which did not include interest caps - were passed by both the House and Senate. read more

WASHINGTON — A former district director of operations for Check ‘n Go, a Mason, Ohio-based payday loan company, accused the company of trying to get a high-level staff member into the Ohio statehouse in an attempt to curb legislation that would restrict payday lending in the state. Mike Donovan, the former district director of operations for Check ‘n Go representing all stores in Washington, D. Rabenold said Check ‘n Go CEO David Davis has been an enthusiastic supporter of his campaign — Davis is among his contributors — but said all contributions have been strictly voluntary. The Raiders and Russell’s agents agreed at midday Tuesday on a six-year, $61 million rookie contract that guarantees him $32 million. Russell’s agents, Ethan Lock and Eric Metz, were still sorting through a 30-page draft Tuesday morning, combing through page after page of a deal that ultimately stands as the richest rookie contract in NFL history. If all goes well, if Russell reaches a number of performance and appearance based incentives, and the Raiders improve as a team and reach certain offensive targets and victory totals, Russell could earn as much as $68 million over the life of the six-year contract. As it’s written, the Raiders are paying Russell $32 million guaranteed, if all his escalators - $3 million of which are backloaded to 2010 - are triggered. Little details, petty squabbles, questions about which Raiders “closer” would be the point man, and which Russell agent would take his turn pitching their numbers, resulted in six months of lost time for a rookie quarterback, the cornerstone of a rebuilding team, who should already be up to speed on the team’s playbook. They got the guarantees they wanted and the Russell contract has an attractive base package because the bulk of the incentives and escalators are backloaded, giving the team three seasons of protection and breathing room. read more
