Would it be wise for me to take a cash advance on a credit card to pay legal fees for Chapter 7 bankruptcy?
Looking For Cash Day Advance Loan Reports
I only ask this because I have been unemployed since November of 2007. The only money I’m making right now is stuff I don’t need that I’m selling (and some stuff I wish I didn’t have to sell) all for saving up money for the legal fees and court costs that will be due to the bankruptcy lawyer I choose before they will file Chapter 7 for me to the court.
This is the last credit card I have that I haven’t defaulted on, but I’m worried that if I take out several hundred dollars to pay for attorney fees/court costs (I know it’s gonna be over $1000 total), that this credit card will come after me saying that I took out a cash advance right before I filed for bankruptcy, including them as one of my creditors.
Just to give you a snapshot of where I’m at: Like I said, I’m making no wages and I have over $28,000 in credit debt. I have been borrowing money from my dad for several months to pay fees and now after the end of March he refuses to loan any more money to me and I will still …
… owe him what I borrowed which has been a few thousand dollars once I find a job which I have been searching for ever since I got laid off last November.
I have just one car, no house, live with my mom. She can’t afford to loan me any money. She can only afford to put a roof over my head. I have about $300 in stock which I am willing to give up to the trustee if I have to to pay my creditors and debt collection agencies. That’s it.
I was told by a lawyer via email to sell all my stuff on Ebay for fair market value. I have no idea what that means. If it means sell used items as new, that’s impossible cuz I could get in trouble with Ebay.
Anyway, I’m totally in a bind here. Please let me know about the cash advance thing and know that there is no possible way for me to pay my debts off in 5 years using Chapter 13 or another method because I have little schooling and therefore it would be hard for me to find a job that paid enough to pay off this sizable amount of debt.
Thanks.
